1. Who provides the service
Plinou is provided in Quebec, Canada. Plinou is a business name of Services Conseils AMD inc., registered with the Quebec Enterprise Register. For any question: support@plinou.com.
Personal information is handled according to the Plinou Privacy Policy, which is part of these terms.
2. What these terms cover
These terms cover:
- the plinou.com website, which anyone can visit;
- Plinou Rendez-vous, Plinou’s online booking application, at rdv.plinou.app, for people and organizations that offer services by appointment (the “users”).
Website design services are governed, for each project, by the written agreement made with the client.
3. Current state of the service
Plinou Rendez-vous is under development. It is not yet open to the public: access is by invitation. During this period:
- features may change, be added or be removed;
- features presented as “coming soon” are not yet available;
- the service is provided as available, and Plinou is glad to hear from you if something is wrong.
4. Your account and its security
- You give accurate information when opening the account and you keep it up to date.
- You keep your password confidential and you do not open an account in someone else’s name.
- You tell Plinou without delay at support@plinou.com if you think someone else is using your account.
- You are responsible for what is done with your account and by the people you add to your organization.
5. Plans, trial, billing and taxes
Plinou Rendez-vous offers a free plan and paid plans. The plans, their content and their current prices are those published on the Plinou Rendez-vous plans page (in French). Paid plans can be tried for 14 days.
A paid plan is billed on the schedule (monthly or yearly) chosen before purchase. Applicable taxes are added to the prices, as the law requires. Online payments go through a payment provider (see section 8). The cancellation and refund terms are shown at the time of purchase.
Plinou may change its plans and prices. A change that affects a paid plan already in progress applies only after reasonable written notice.
6. Your content, your data and your clients’ data
You remain the owner of the content you put in Plinou Rendez-vous: your texts, your settings, your logos and your clients’ information. You give Plinou permission to host and process it, only to provide the service to you.
When your clients book with you, you are responsible for their information. Plinou acts as your service provider, as described in the privacy policy. This means you must:
- have the right to collect this information and tell your clients how you use it;
- answer their requests for access, correction or withdrawal, with Plinou’s help;
- not enter any health information in the free fields of a client record, because Plinou Rendez-vous is not made to keep clinical notes;
- follow the laws and the rules of your profession.
7. What is not allowed
You may not use Plinou to:
- do anything illegal, misleading or harmful to other people;
- send unsolicited messages or spam;
- try to access other people’s accounts or data, or get around the service’s security;
- overload the service, copy it, take it apart or extract its data by automated means without permission;
- pretend to be another person or organization.
8. Third-party services
Plinou Rendez-vous can connect to third-party services that you choose: Google (Calendar, Drive, Meet), Microsoft (Outlook, OneDrive, SharePoint, Teams), Zoom, Stripe and PayPal. These services have their own terms and privacy policy, which you accept directly with them. Plinou is not responsible for them and does not control their availability.
You can disconnect a service at any time. Data received from Google is handled as explained in section 6 of the privacy policy.
9. Availability of the service
Plinou does its best to keep the service available and secure. It cannot promise that the service will run without interruption or error. Outages may happen for maintenance or because of problems beyond its control. Keep a way to reach your clients in case the service is unavailable.
10. Limit of liability
Plinou is liable for the direct damage it causes you through its fault. It is not liable for indirect damage, such as lost income, lost clients or lost business opportunities, nor for damage caused by a third-party service or by a use of the service that goes against these terms. To the extent the law allows, Plinou’s total liability to you is limited to the amounts you paid for the service concerned.
This limit does not apply in cases of gross or intentional fault, bodily injury, or any other case where the law does not allow liability to be limited. Nothing in these terms reduces the rights the law gives you, including those of a consumer.
11. Ending use, exporting your data
You can close your account at any time. When an organization closes, its data is given to it in an export, then destroyed 30 days later, as the privacy policy explains.
Plinou may suspend or close an account that does not follow these terms, after telling you, unless the security of the service or of other people requires immediate action. If Plinou ends the service, it tells you in advance and gives you time to export your data.
12. Plinou’s property
The Plinou name, the logo, the website and the application belong to Plinou or its licensors. These terms give you only the right to use them as set out here.
13. Changes
Plinou may change these terms. The date at the top of the page shows the latest version. For an important change, users are notified by email before it takes effect. If you keep using the service after that date, you accept the new terms. Otherwise, you can close your account.
14. Governing law
These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. The courts of the judicial district of Montréal have jurisdiction, subject to the rights a consumer holds under the law.
